Ticketing Terms and Conditions

PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE TICKET PURCHASING SERVICE OR MAKING ANY TICKET PURCHASE.

This ticket is a revocable license to attend a specific event. The holder, on behalf of the holder and any minor accompanying the holder (individually and collectively, the “Holder”), agrees to all of the terms hereof. By purchasing this ticket on our website, the Holder also agrees to be bound by the Terms and Conditions of Sale associated with this ticket (presented below), as well as by the Terms of Use for the White Oak Music Hall Website, which is incorporated herein by reference.

The Holder agrees not to transmit, distribute, or sell (or aid in transmitting, distributing, or selling), in any media now or hereafter existing, any description, account, picture, video, audio or other form of reproduction of the event or any surrounding activities (in whole or in part) for which this ticket is issued (the “Event”).

Breach of any of the terms of this license, failure to comply with venue rules, or the refunding to the Holder of the printed purchase price of this ticket, shall automatically terminate any rights that the Holder may have hereunder; shall render illegal and unauthorized the Holder’s use of the ticket for any purpose; and shall authorize White Oak Music Hall to withdraw the ticket, refuse admission to the venue or eject the Holder from the venue. White Oak Music Hall may refuse admission to, or eject, any Holder, without refund, who is deemed to be disorderly, intoxicated, and/or who fails to comply with the terms of this license or any and all security measures. Breach of any of the terms of this license shall also subject the Holder to all legal remedies available to White Oak Music Hall and its affiliates.

Resale or attempted resale of this ticket in violation of applicable law is grounds for seizure or cancellation without refund or other compensation. Except as otherwise specifically provided by White Oak Music Hall, it is unlawful to copy or otherwise reproduce this ticket. The Holder grants permission to White Oak Music Hall (and its designees, licensees and agents) to utilize, use, reproduce, modify, display, and publish the Holder’s image, likeness, actions and statements in any live or recorded audio, video, or photographic display or other transmission, exhibition, publication or reproduction made of, or at, the Event in any context or media now or hereafter existing for any purpose, including commercial or promotional purposes, without further authorization or compensation.

THE HOLDER OF THIS TICKET VOLUNTARILY ASSUMES ALL RISK AND DANGER OF PERSONAL INJURY (INCLUDING SICKNESS AND DEATH), PROPERTY DAMAGE, AND ALL OTHER HAZARDS ARISING FROM, OR RELATED IN ANY WAY TO, THE EVENT, WHETHER OCCURRING PRIOR TO, DURING OR AFTER THE EVENT HOWSOEVER CAUSED AND WHETHER BY NEGLIGENCE OR OTHERWISE. THE HOLDER AGREES THAT WHITE OAK MUSIC HALL (AND ITS AGENTS, OFFICERS, DIRECTORS, OWNERS AND EMPLOYEES) IS NOT LIABLE FOR ANY DAMAGES OR INJURIES RESULTING FROM SUCH CAUSES. 

HOLDER SPECIFICALLY ACKNOWLEDGES THAT THE COVID-19 PANDEMIC REMAINS A THREAT TO PUBLIC HEALTH, COVID-19 IS A HIGHLY CONTAGIOUS DISEASE TRANSMITTED THROUGH HUMAN CONTACT AND RESPIRATORY DROPLETS (INCLUDING THROUGH THE AIR AND VIA COMMON SURFACES) AND IT IS POSSIBLE THAT HOLDER MAY CONTRACT COVID-19 WHILE AT THE EVENT FOR WHICH THIS TICKET IS ISSUED. 

Holder bears all risks of inclement weather or Force Majeure events. Force Majeure events include, without limitation, fire, accident, acts of God, severe weather conditions, power outages, telecommunication interruption, strikes or labor disputes, war or other violence, or any law, order, proclamation, regulation, ordinance, demand or requirement of any governmental agency). Event date and time are subject to change.

In purchasing tickets, you may be linked to a third-party site that is not affiliated with our Services. WE ARE NOT RESPONSIBLE FOR ANY ASPECT OF THIRD-PARTY WEB SITES, INCLUDING PURCHASES MADE ON THOSE SITES. Please make sure to review the terms and conditions that you will find on these third-party sites. We are not responsible for the conduct of the operators of third-party sites, and we cannot ensure that you will be satisfied with any products or services that you purchase from a third-party website that is or claims to be associated with the Event. We do not endorse any of the merchandise, nor have we taken any steps to confirm the accuracy or reliability of, any of the information contained in such third-party sites or content. We do not make any representations or warranties as to the security of any information (including, without limitation, credit card and other personal information) you might be requested to give any third-party, and you hereby irrevocably waive any claim against us with respect to such sites and third-party content. We strongly encourage you to make whatever investigation you feel necessary or appropriate before proceeding with any online or offline transaction with any of these third parties.

The Holder and the Holder’s belongings may be searched upon entry into the venue, and the Holder consents to such searches and waives any related claims that might arise against White Oak Music Hall. If the Holder elects not to consent to these searches, the Holder will be denied entry into the venue.

Opening acts or attractions sometimes tour with headlining performers for certain concerts or shows. White Oak Music Hall is not always informed of the identity or nature of any such opening acts or attractions. Opening acts or attractions for a particular concert or show may be added, changed or cancelled at any time without notice and the Holder of this Ticket will not be entitled to any refund or other reimbursement in connection with any such addition, change or cancellation.

ALL SALES ARE FINAL. The Holder should treat this ticket as a regular ticket and keep it in a safe place at all times. White Oak Music Hall is not responsible for any loss or inconvenience caused by any unauthorized duplication of this ticket. In the event duplicate copies of this ticket are presented, White Oak Music Hall reserves the right to refuse entry to the Event for all ticket holders.

This ticket cannot be replaced if lost, stolen or destroyed. Lost, stolen, counterfeit or otherwise unlawfully duplicated tickets, or those offered for resale at an unlawful premium, or on an unauthorized electronic secondary marketplace, may not be honored. White Oak Music Hall may refuse admission to, or eject, any Holder, without refund, who is deemed to be disorderly or who fails to comply with the terms of this license or any and all security measures.

THE EVENT MAY BE SUBJECT TO CANCELLATION AND THE DATE, TIME, TICKET PRICES, TICKET AVAILABILITY, TICKETING AMENITIES, LOCATION, ADMISSION REQUIREMENTS, PERSONAL CONDUCT REQUIREMENTS, SECURITY REQUIREMENTS, AND FEATURED PERFORMERS OF THE EVENT ARE SUBJECT TO CHANGE. If the Event is rescheduled, this ticket may only be exchanged pursuant to procedures established by White Oak Music Hall. If the Event is cancelled (and not rescheduled), White Oak Music Hall shall refund to Holder the face value of the ticket, associated taxes, and facility fees. Service fees charged by Ticketmaster and credit card processing fees charged by Ticketmaster and/or credit card processing entities are non-refundable. The time of remittance for any refunds will depend on a number of factors but White Oak Music Hall will work diligently to insure payment as soon as practical or able. White Oak Music Hall cannot issue refunds to Holder if Holder obtained his/her ticket from an unauthorized third-party reseller; in those cases, refunds must be obtained from the party whom Holder purchased the ticket. When Holder has purchased his/her ticket from a third-party ticketing company authorized to sell tickets on behalf of White Oak Music Hall, Holder shall receive a refund from said ticketing company.

ALL EVENTS AT WHITE OAK MUSIC HALL ARE RAIN OR SHINE and refunds shall not be issued in case of inclement weather with the exception of complete cancelation of an event. White Oak Music Hall continuously monitors weather reports, and if conditions indicate the presentment of the show may be unsafe due to rain, lighting, wind, or other unsafe condition, White Oak Music Hall may elect to cancel the event (in case where inclement weather conditions are not expected to improve) or delay/postpone the event (in cases where weather conditions are temporary). Evaluation of weather conditions is made at the site of the venue, despite inclement weather that may exist at other parts of the city and surrounding area.

IN NO EVENT WILL WE OR OUR EVENT PROVIDERS, SUPPLIERS, ADVERTISERS AND SPONSORS, BE RESPONSIBLE OR LIABLE TO YOU OR ANYONE ELSE FOR, AND YOU HEREBY KNOWINGLY AND EXPRESSLY WAIVE ALL RIGHTS TO SEEK, DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES OF ANY TYPE, AND ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED, ARISING OUT OF OR IN CONNECTION WITH THE SITE, THE CONTENT, OR ANY PRODUCT OR SERVICE PURCHASED THROUGH THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND REGARDLESS OF WHETHER THE CLAIM IS BASED UPON ANY CONTRACT, TORT, OR OTHER LEGAL OR EQUITABLE THEORY. WITHOUT LIMITING THE FOREGOING, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT WE WILL HAVE NO LIABILITY OR RESPONSIBILITY WHATSOEVER FOR : (a) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (b) ANY ERRORS, MISTAKES, INACCURACIES OR OMISSIONS IN ANY CONTENT, (c) ANY LOST, STOLEN OR DAMAGED TICKETS, OR THE FAILURE OF A VENUE TO HONOR A TICKET, OR (d) ANY EXPENSES OR LOSSES INCURRED BY YOU DUE TO A CHANGE IN THE DATE, TIME, TICKET PRICE, TICKET AVAILABILITY, TICKETING AMENITIES, LOCATION, OR FEATURED PERFORMERS OF AN EVENT. YOUR SOLE AND EXCLUSIVE REMEDY FOR DISSATISFACTION IS A REFUND OF THE FACE VALUE OF THE TICKETS, ASSOCIATED TAXES, AND FACILITY FEES YOU HAVE PAID TO US FOR THE APPLICABLE EVENT, IF SUCH REFUND IS AUTHORIZED IN THESE TERMS AND CONDITIONS. THE LIMITATIONS IN THIS SECTION WILL APPLY EVEN IF ANY LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE. THE ALLOCATION OF RISK BETWEEN US IS AN ESSENTIAL ELEMENT OF THE BASIS OF THE BARGAIN BETWEEN US. OUR AGGREGATE LIABILITY ARISING OUT OF THESE TERMS OR THE USE OF THE SITE WILL NOT EXCEED THE FACE VALUE OF THE TICKETS, ASSOCIATED TAXES, AND FACILITY FEES YOU HAVE PAID US FOR THE APPLICABLE EVENT. IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE. OUR LIABILITY WILL BE LIMITED UNDER THIS PARAGRAPH TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.  SHOULD HOLDER MAKE A CLAIM AGAINST WHITE OAK MUSIC HALL CONTRARY TO THE TERMS OF THIS AGREEMENT, WHITE OAK MUSIC HALL, AS A PREVALING PARTY, SHALL BE ENTITLED TO RECOVER ITS ATTORNEYS FEES FROM HOLDER.

We may add to, change or remove any part of these Terms at any time, without notice. Any changes to these Terms or any Terms shown on the Services apply as soon as they are shown. By continuing to use the Services after any changes are posted, you are indicating your acceptance of those changes. It is therefore your responsibility to check these Terms each time you use the Services, so that you can take note of any amendments we may make. We may add, change, discontinue, remove or suspend any other content displayed on the Services, including features and specifications of products and services described or depicted on the Services, temporarily or permanently, at any time, without notice and without liability.

Any waiver of any provision of these Terms must be in writing, and must be signed by the party waiving its rights in order to be valid. A waiver of any provision hereunder shall not operate as a waiver of any other provision, or a continuing waiver of the same provision in the future. If any court of competent jurisdiction finds any provision of these Terms to be void or unenforceable for any reason, then such provision shall be ineffective to the extent of the court’s finding without affecting the validity and enforceability of any remaining provisions. These Terms represent the entire understanding and agreement between the parties relating to the subject matter herein and supersede any and all prior statements, understandings or agreements whether oral or written, and shall not be modified except in writing, signed by you and us.
